This license is an agreement between you and Dataheroes s.r.o. ("Dataheroes") about the Inkhero software, including its program files, icons, artwork and documentation (the "Software"). By installing or using the Software you accept this license. If you do not accept it, do not install or use the Software.
1. Use
Dataheroes gives you a non-exclusive, non-transferable right to install and use the Software on any number of your own devices, for personal or business use.
2. Redistribution
You may copy and distribute the Software, but only in its original, unmodified form, together with this license, and without charging for the Software itself. This includes distribution through software stores and package repositories such as Flathub, and through their mirrors.
3. Restrictions
Except as allowed in section 2 and in section 4, you may not:
- a) modify, translate or create derivative works of the Software;
- b) decompile, disassemble or reverse engineer the Software;
- c) sell, rent or sublicense the Software;
- d) remove or change any copyright notices or this license.
4. Third-party components
The Software uses open-source components, such as Qt and KDE Frameworks, that are provided under their own licenses. Those licenses are listed in the THIRD_PARTY_NOTICES file that comes with the Software. Nothing in this license limits your rights under those licenses. In particular, you may replace or modify the libraries provided under the GNU Lesser General Public License, and reverse engineer the Software as far as needed to debug such changes.
5. Your data
Your notes, pictures and settings are stored on your device. They belong to you. The Software connects to the internet only to fetch previews for links you paste into a note, and to download pictures you drag into a note from a web page.
6. Ownership
The Software is licensed, not sold. Dataheroes keeps all rights, title and interest in the Software that are not given to you in this license.
7. No warranty
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.
8. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, DATAHEROES IS NOT LIABLE FOR ANY DAMAGES ARISING FROM THE USE OF, OR INABILITY TO USE, THE SOFTWARE, INCLUDING LOSS OF DATA. Keep backups of your notes, for example with the Export function in Settings.
9. End of the license
This license ends automatically if you break its terms. When it ends, you must stop using the Software and delete all copies of it.
10. Governing law
This license is governed by the laws of the Slovak Republic. Disputes will be decided by the courts of the Slovak Republic. If you are a consumer, you keep all rights that the mandatory consumer protection laws of your country give you, and sections 7 and 8 apply only as far as those laws allow.
